
We documented 159 cases and provided accompaniment to 90 of them across 9 states in the country: abortion access denial 73, abortion criminalization 3, obstetric violence 10, maternal death 1, rights violations in the context of assisted reproductive techniques 2, and violations of the right to care 1. We followed up on 245 cases from previous years and closed 105 comprehensive accompaniments.
The Queretaro State First District Court in Criminal Matters issued a favorable ruling on the legal stay filed against a hospital of the Mexican Social Security Institute (IMSS) that denied Esmeralda an abortion on health grounds. She accessed the service and, subsequently, the Court ordered comprehensive reparation measures with the collaboration of the Executive Commission for Victim Assistance (CEAV) and the State Commission for Comprehensive Victim Assistance of Querétaro. This case constitutes a benchmark in the state, as it documented and made visible the structural barriers that obstruct access to abortion services.
Based on a ruling issued by the National Supreme Court of Justice in 2024, the Executive Commission for Victim Assistance fulfilled all comprehensive reparation measures for a case concerning an adolescent who, in 2021, after suffering sexual assault, went to a health institution in Jalisco where she did not receive information about her right to terminate the pregnancy. The comprehensive reparation measures had a positive impact on the adolescent’s life by restoring her reproductive autonomy, strengthening her emotional wellbeing, and providing her with dignified conditions.
The Tenth Collegiate Tribunal in Administrative Matters confirmed the government’s patrimonial liability, establishing the obligation to provide compensation for the irregularities committed in the case of Yessica, whom we have accompanied since 2022 for acts constituting obstetric violence in public hospitals in the State of Mexico and Mexico City. This ruling strengthens the criteria for comprehensive reparations for those whose reproductive rights were violated.
Based on the precedent of Unconstitutionality Action 148/2017 resolved by the Supreme Court of Justice of the Nation in 2021, the Territorial Investigation Prosecutor’s Office in Álvaro Obregón proposed non-prosecution and, thereby, the closure of the investigation file against a young woman from Mexico City who in 2023 suffered a miscarriage and was criminalized after seeking care at a health institution in the Magdalena Contreras delegation.
An adolescent from Mexico City, whose pregnancy aggravated a preexisting cardiac condition and put her health at risk, accessed an abortion at an institution with the necessary specialization. In this case, an effective coordination between institutions was carried out to guarantee health services in accordance with the clinical needs of pregnant persons.
Comprehensive reparation measures were granted to Diana, a young woman in Chihuahua who in 2022 was denied an abortion due to rape with the argument that she had already exceeded 12 weeks of gestation, despite the fact that the applicable legislation and NOM-046 establish the right to access this health service without a time limit. The Executive Commission for Victim Assistance of the State of Chihuahua urged the hospital that denied care to train its staff and guarantee the abortion service in cases of rape.
Jessica, a young woman with a disability from Chiapas, accessed an abortion due to rape at a health institution in that state. Her case was taken up and resolved by the Supreme Court of Justice of the Nation, which established the unconstitutionality of restricting abortion accesso due to rape to a time limit. Based on this case, the local Congress removed said limit from the criminal code and, subsequently, in compliance with an SCJN ruling, decriminalized abortion during the first 12 weeks of gestation. From 2022, the year in which Jessica was entered into the victim registry of the Executive Commission for Victim Assistance for the State of Chiapas, through 2025, the fulfillment of the comprehensive reparation measures was carried out.
